bangari® Terms and conditions

These are the terms and conditions (“Terms”) for the sale and purchase of the goods (“Goods”) listed on the website and mobile website bangari.org (“Website”). Please read these Terms carefully, together with the privacy policy which can be found here (“Privacy Policy”). they govern bangari®’s relationship with you in relation to the Website and all purchases made by you on the Website.

We may update these Terms at any time. You should check these Terms before placing each order to ensure that you are aware of any changes. These Terms were updated on 15-FEB-2020.

Please note that before subscribing/placing order for our products, you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order any Goods from us or on the Website. Also note that if the payment is online we assume that you have accepted the terms and conditions upon receiving the receipt of the payment made buy any other mean except online.

The quickest and easiest way to contact us in the event of any queries or problems is via our customer care representative (“bangari® Customer Experience”) on 7348970333. Our Customer Experience is available is select working time during all over the year.

To register with bangari® via the Website or in person you must be 18 years of age or older. You must ensure that the details provided by you on registration are correct, and inform us immediately of any changes by updating your personal details.

These Terms do not affect your statutory rights.

How the Contract is formed between You and Us

  1. The Website will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.
  2. All purchases made are governed by the latest version of these Terms existing at the time of order. Accordingly, you should check prior to each order to ensure that you understand the precise Terms applicable to your purchase. To assist you in determining whether the Terms have changed since your most recent order we will display the date when these Terms were most recently updated at the top of this page. Prior to placing an order you will be asked to confirm that you have read and accepted these Terms.
  3. You may place, cancel, amend or correct orders online, by phone or in person. Orders can be amended or cancelled at least 24 to 48 prior to the time of delivery. Orders/subcriptions can be paused or amended or cancelled by phone to our Call Center or also via the pause request form on website. It is not possible to amend an order before 48 hours and after 24 hours from the time of delivery of milk/Any Product. However, if you wish to cancel your order after delivery you may do so in accordance with paragraph 13 of these Terms.
  4. Goods will not be supplied for the purposes of resale, and are only supplied for your own use as a consumer. If it is for the purpose of resale, then the Retailer registration with bangari® must be activated and running. Images of the Goods are provided for illustration purposes only. We cannot guarantee that your computer’s display of the colors accurately reflects the color of the Goods. The packaging of the Goods may vary from that shown on images on the Website.

Customer Registration and Placing an Order for Goods

  1. You will need to register as a Customer/member to avail bangari® Products & Services. You can register online, via phone or through bangari® Authorized representatives before you will be able to place an order. To register as a Customer/member of bangari® you can fill the order/subscription form on this website.
  2. For contractual purposes, by registering your consent to receive communications from us electronically you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
  3. The Delivery of the member shall be address specific. Change of address of the customer/member makes no obligation on bangari® to deliver the milk at the new address. Delivery to the new address is solely prerogative of bangari® and if the delivery to the new address is not possible, then the Member can discontinue the services as per the terms.
  4. The Members can either place onetime order or Monthly Order. The kind of order are explained as under
    1. ONE TIME ORDER – An order which the member shall place based on his/her requirement. Order for the ONE TIME ORDER needed to be made between 24 to 48 hours before the time of delivery.
    2. MONTLY ORDER – The registered member can make a monthly order based on his/her desire. Any changes on the monthly plan can made before 24 to 48 hours before delivery. Any changes or amendment in the monthly plan will be reflected in 24 to 48 hours from the time of request.

Price

  1. The price of the goods will vary depending on whether you place a One time Order or a Monthly Order as follows:
  2. One Time Order – For One Time Orders, the price of the Goods will be as quoted on at the time you placing of your order.
  3. Monthly Order – The Monthly Order rate shall be relatively less than the One Time Order Rate. The Monthly Order shall be provided to you at the time of booking. The rate for the monthly order may vary in promotional period and normal period.
  4. Price for dairy products other than the milk offered by bangari® shall be as per the rates mentioned on the products.

Order Confirmations

  1. After you place an order, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted. Our acceptance of your order will take place as described in paragraph below.
  2. Orders will only be confirmed for delivery once they have received your payment.
  3. The order confirmation shall be given upon placing of the order by the delivery shall happen upon receiving the full payment for the same.

How to Pay

  1. You can pay for the good by any of the following manner:
    1. Cash – NOT SO RECOMMENDED. MUST BE THE LAST OPTION.
    2. Cheque
    3. Net-Banking/NEFT
    4. UPI/GooglePay/PhonePe
    5. Credit/Debit Crads

Credit Limits and Payment Failures

  1. We reserve the right to monitor your payment history and apply varying credit limits to your account as we deem appropriate. This means that once your credit limit has been exceeded you will not be able to place any further orders until an interim payment is made to bring your account back within its credit limit.
  2. You agree not to hold us responsible for banking charges incurred due to payments made on your account.
  3. We reserve the right to suspend your membership and any further deliveries and take any other action as we consider appropriate in the event of (1) a failed payment: (2) us being refused authority for payment or (3) our reasonable belief that payment will be refused at any stage.
  4. You agree to compensate us in full against all reasonable costs, expenses and outgoings incurred by us in obtaining payments from you in the event a failed payment occurs. We may at any time after a failed payment has occurred ask a debt collection agency to collect payment from you and/or issue proceedings in court.
  5. You agree further that in terms of any credit advanced the sum outstanding must be paid off in no more than one payment and no later than 30 days from the date of order.

Delivery

  1. Delivery is free of charge and will be made to the address specified by you when you register on the Website. We reserve the right to restrict or cease deliveries in any area at our sole discretion.
  2. When you register with bangari®, you will be advised of the time on which our local milkman delivers in your area. For example, if our milkman delivers in your postcode area by 7:00 am to 7:30 am then you will be offered that time for delivery on a routine basis.
  3. Subject to paragraph 8.2, delivery will be made on the time you have requested, usually after 5am and before 9am. However due to the nature of our business we cannot guarantee your order will be delivered by a certain time. Please see our FAQ page for more information.
  4. bangari® reserves the right to alter your time of delivery and your milkman at its discretion. We will always do our best to confirm this change to you in advance of the change taking place.
  5. Goods are subject to availability and prevailing market conditions. We may limit the quantities of Goods (particularly Goods on special offer) supplied to any one customer if in our opinion the quantity ordered jeopardizes availability for other customers.
  6. If you are going on holiday and you would like to postpone your deliveries. the subscription can be paused but the same has to be informed 48 hours in advance on the website or contact form so we can make the necessary adjustments to our scheduling. The refund on the same shall be adjusted to the subscription cycle. Any refund shall be subject terms and conditions.

Substitutions

  1. In the event of non-availability of any Goods you order, we may offer a reasonable substitute.
  2. Where a substitute item is offered in place of an item ordered, every effort will be made to bring you a product of equivalent or better quality and value as the original item and the price you will be charged will be the lesser of the original and the substitute item.

Defective or Incomplete Goods

  1. In the event that the goods delivered to you are incomplete, include incorrect Goods or if any of the Goods are defective, please notify us as soon as possible so that we can investigate and (if applicable) provide an appropriate remedy to you.

Our Liability to You

  1. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this contract.
  2. We only supply the Goods for domestic and private use. You agree not to use the Goods for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Events Outside Our Control

  1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in paragraph.
  2. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation cattle health, milk output quality, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport or disruption to the Website or Call Centre.
  3. If an Event Outside Our Control takes place that affects the performance of our obligations under a contract:
    1. we will contact you as soon as reasonably possible to notify you; and
    2. our obligations under a contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Goods to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.
  4. You may cancel a contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact us by calling our Call Centre. If you opt to cancel, you will have to return (at our cost) any relevant Goods you have already received and we will refund or credit to you the price you have paid.

Your Right to Cancel Your Order after Delivery

  1. You may cancel, amend or correct orders prior to delivery in accordance with these terms and conditions.
  2. Goods which may not be returned after delivery are:
    1. items which are liable to deteriorate or expire rapidly, for example milk, other dairy products, bread and so on (“Perishable Items”); or
    2. items which have been unwrapped or unsealed and cannot be resold for health or hygiene reasons, for example tin foil, toilet rolls and so on.

Privacy

  1. bangari® is committed to preserving your privacy. The personal information you provide will enable us to provide you with the Goods you require. We will not transfer, disclose, sell, distribute or lease your personal information to third parties other than in accordance with our Privacy Policy. Please see our Privacy Policy for more information about our use of your personal information.

Use of the Website and our Intellectual Property Rights

  1. We have made the Website available to you for your own personal use. We may modify, withdraw or deny access to the Website at any time.
  2. The Website and all the materials contained in it are protected by intellectual property rights, including copyright, and either belong to us or are licensed to us to use. Materials include, but are not limited to, the design, layout, look, appearance, graphics and documents on the Website, as well as other content such as articles, stories and other text (“Materials”).
  3. Some of the blogs articles in the website are written or prepared by other authors. bangari® has made all efforts to recognize them are the author of the article. If anyone has any objection to the same please contact us by an email to [email protected].
  4. You may not copy, redistribute, republish or otherwise make the Materials on the Website available to anyone else without our consent in writing.
  5. You may print or download materials from the Website for your own personal use or copy the content to other individuals for their personal information provided that:
    1. No Materials are modified in any way;
    2. No graphics are used separately from accompanying text;
    3. Our copyright and trade mark notices appear in all copies and you acknowledge the Website as the source of the Material; and
    4. the person to whom you are providing the Materials is made aware of these restrictions

Limitation of Liability in Relation to the Website

  1. The Website should only be used for information purposes. It is not advice and you should not rely on it to make (or refrain from making) any decisions or take (or refrain from taking) any action.
  2. bangari® does not guarantee that the Website will operate free of error or that it is free from computer virus or any other contaminating computer programs.
  3. The Website is made available for public viewing on the basis that bangari® excludes to the fullest extent lawfully permitted all liability whatsoever for any loss or damage howsoever arising out of the use of the Website or reliance upon the content of the Website.
  4. The Website is provided by bangar® without any warranties or guarantees. You must bear the risks associated with the use of Internet. In particular, we disclaim all liabilities in connection with the following:
    1. incompatibility of the Website with your software, equipment or telecommunication links;
    2. technical problems including errors or interruptions of the Website; and
    3. inadequacy of the Website to meet your requirements.
  5. The website have listed out some additional products in the market. Some of the said products are available in the market, some are in development and some may be awaiting fssai approval. The goods will be made available in the market as and when and how bangari® deems fit.

Information on the Website

  1. The information contained on the Website is given for general information and interest purposes only. Whilst we try and ensure the information contained on the Website is accurate and up to date, we cannot be responsible for any inaccuracies in the information. As a result, you should not rely on this information, and we recommend that you take further advice or seek further guidance before taking any action based on the information contained on the Website. Our liability to you as explained above remains unaffected by this.

Our Rights

  1. We reserve the right to:
    1. modify or withdraw, temporarily or permanently, the Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
    2. change the Terms from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms have been changed. If you do not agree to any change to the Terms then you must immediately stop using the Website.

Linking

  1. The Website contains links to websites owned and operated by third parties. If you use these links, you leave the Website. Where we provide the link we have limited control over the contents of the linked website but we are not responsible for any linked website or their content or availability. If you wish to purchase products from such third party website, bangari® is not a party to any such contract for the purchase between you and any seller.
  2. We accept no liability for any damage or loss, however caused, in connection with the use of or reliance on any information, material, products or services contained on or accessed through any such linked website.
  3. You may not link to the Website from another website without our consent in writing.

Other Important Terms

  1. We may transfer our rights and obligations under a contract to another organisation, but this will not affect your rights or our obligations under these Terms. We will always notify you by posting on this webpage if this happens.
  2. You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.
  3. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
  4. If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
  5. The formation, existence, construction, performance, validity and all aspects whatsoever of these Terms or of any paragraph of these Terms will be governed by the law of England and Wales.
  6. The Mysore District courts will have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these Terms or use of the Website.
